Introduction

Welcome to our platform. These Terms and Conditions ("Terms") govern your access to and use of our website, mobile applications, and services (collectively, the "Platform"). The Platform provides decentralized digital identification, custodial wallet services, social media features, and a digital marketplace.

By accessing or using our Platform, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Platform.

Eligibility

You must be at least 18 years old to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

The Social Contract

By using the Platform, you agree to adhere to our Social Contract, which outlines the rights and responsibilities of all participants in our ecosystem. The Social Contract is a living document that may be updated through community voting. You are responsible for reviewing the Social Contract periodically to ensure continued compliance.

The Social Contract includes our commitment to providing universal basic income in cryptocurrency form to all users, as well as maintaining an environment free from hate speech and discriminatory behavior.

Account Registration and Security

Registration

To access our Platform, you must register for a decentralized identity. This registration is specifically for identity creation, while the actual application utilizing this identity is located separately. During registration, you will be required to provide certain information, including but not limited to:

• First and last name
• Email address
• Password
• Country of residence
• Referral code

Identity Verification

While basic social features are available immediately upon registration, access to economic features (including wallet services and marketplace participation) requires additional identity verification, including submission of government-issued photo identification. This verification is required to comply with regulatory requirements.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security.

Custodial Wallet Services

Digital Asset Custody

We provide custodial wallet services that allow you to store, send, receive, and manage digital assets through our Platform. By using our wallet services, you authorize us to hold your digital assets on your behalf.

Ownership of Digital Assets

You retain ownership of your digital assets stored in your custodial wallet. We act as a custodian of these assets and will hold them in accordance with these Terms.

Dormant Accounts

If your account becomes dormant (as defined by applicable regulations), we may be required to treat your digital assets as unclaimed property. After the legally required holding period, unclaimed digital assets may be donated as permitted by applicable law.

Social Media Features

User-Generated Content

You may generate, post, and share content on our Platform. You retain any intellectual property rights you may have in the content you create and share on the Platform.

License to Display Content

By posting content on the Platform, you retain your intellectual property rights but grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content in connection with the operation and provision of the Platform services.

Prohibited Content

You agree not to post or share content that:

• Promotes nazism, fascism, or similar ideologies
• Promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, or age
• Contains illegal material or promotes illegal activities
• Infringes upon the rights of others
• Contains malicious software or code

Digital Marketplace

Transactions

The digital marketplace allows users to buy, sell, and trade digital assets. All transactions are governed by the terms of the applicable smart contracts.

Transaction Fees

We charge a 0.5% fee on all transactions conducted through the marketplace. This fee is automatically deducted from the transaction amount. All collected fees are used to raise and maintain the value of MUNNY, our platform’s cryptocurrency.

Dispute Resolution

Disputes between users regarding marketplace transactions will be resolved according to the rules specified in the relevant smart contracts, which may include arbitration as a last resort.

No Refunds

We do not offer refunds for purchases made through the marketplace. However, users may recoup value by reselling purchased items through the marketplace.

Universal Basic Income

As part of our commitment to economic inclusion, we provide universal basic income in cryptocurrency form to all verified users. The amount, frequency, and type of cryptocurrency distributed may change over time. Receipt of universal basic income is subject to continued compliance with these Terms and the Social Contract.

Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Platform for any illegal purpose
• Attempting to interfere with, compromise, or disrupt the Platform
• Impersonating another person or entity
• Attempting to gain unauthorized access to other users’ accounts
• Using automated means, bots, or data scraping tools to access or use the Platform
• Sharing information obtained through the Platform with external parties ("what happens in the app stays in the app")
• Using the Platform for commercial purposes without proper registration and validation
• Engaging in any activity that disrupts other users’ enjoyment of the Platform

Termination

We reserve the right to suspend or terminate your access to the Platform, in our sole discretion, for any reason, including but not limited to violation of these Terms or the Social Contract. Consequences may include warnings, temporary suspension, permanent ban, or legal action, depending on the severity and nature of the violation.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM:

• YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE PLATFORM
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM
• ANY CONTENT OBTAINED FROM THE PLATFORM
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
• LOSS OF DIGITAL ASSETS DUE TO USER ERROR, FORGOTTEN PASSWORDS, OR PHISHING ATTACKS

The foregoing limitation of liability shall not apply to liability that cannot be excluded or limited by applicable law.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee that:

• The Platform will meet your requirements
• The Platform will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Platform will be accurate or reliable
• The quality of any products, services, information, or other material purchased or obtained through the Platform will meet your expectations

Taxes and Compliance

You are solely responsible for determining what, if any, taxes apply to your transactions on the Platform. It is your responsibility to report and remit the correct tax to the appropriate tax authority. We are not responsible for determining whether taxes apply to your transactions or for collecting, reporting, withholding, or remitting any taxes arising from any transactions.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. You and we agree to submit to the personal and exclusive jurisdiction of the courts located within Florida.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes to these Terms, we will provide notice through the Platform or by other means. Your continued use of the Platform after such notice constitutes your acceptance of the modified Terms.

By using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms.
